1. Applicability of the Terms and Conditions

These Terms and Conditions apply to all services provided by Mounir Weine AG and take effect—in the version valid at the time of the order—upon the formation of a contract. Any deviating provisions on the part of the contracting party are therefore invalid. By submitting an order toMounir Weine AG, the customer confirms that they have read these Terms and Conditions and expressly agrees to them.

 

2. Formation of a Contract

Sales contracts are concluded upon acceptance of the order byMounir Weine AG. Acceptance of the order is confirmed to the customer via email and is subsequently binding on the customer. Any delivery issues will also be communicated to the customer via email as soon as possible. By placing an order, the customer confirms that they are fully aware of the scope and contents of their order. Any questions regarding this matter can therefore be clarified with us in advance.

 

3. Deliveries / Shipping Costs

Goods are generally shipped via mail or courier.
In the rare event that an item in our product range is unavailable, the customer will be notified via email as soon as possible. We generally reserve the right to make partial deliveries if this appears to facilitate the fastest possible fulfillment of the entire order. We also reserve the right to fulfill an order only to the extent that the items are available.
As a general rule, the stated estimated shipping times for the items are based on experience and are therefore not binding on Cave du RhodanMounir Weine AG.

Foodservice: Free delivery to your location for orders of 60 units or more (1 unit equals: 1 bottle of 75 cl, or 2 bottles of 50 cl, or 1 bottle of 37.5 cl)
Wholesalers: Free delivery to your address for orders of 300 units or more (1 unit equals: 1 bottle of 75 cl, 2 bottles of 50 cl, or 1 bottle of 37.5 cl)

 

4. Price Information

As a general rule, we strive to offer our customers products at the best possible price; however, this is closely tied to our suppliers’ prices.Mounir Weine AG therefore expressly reserves the right to adjust the prices listed online without prior notice and without further explanation. For orders and delivery, the following principle applies: the price valid at the time the order is placed on the website is the one used for billing.

 

5. Value-Added Tax

Prices for Switzerland and the Principality of Liechtenstein include the legally required value-added tax of 8.1%.

6. Customs Fees for Customers Abroad

Orders placed on www.rhodan.ch are shipped exclusively to Switzerland and the Principality of Liechtenstein.

 

7. Foreign Currency

Mounir Weine AG offers customers from abroad the option to pay for their orders in either euros (€) or U.S. dollars ($). The exchange rate used for this purpose generally corresponds to the current daily rates.

 

8. Returns

As a general rule, the right to return ordered merchandise applies only in the event of an incorrect delivery by Mounir Weine AG, manufacturing defects, or damage incurred during shipping. We therefore expressly ask our customers to promptly inspect the delivery upon receipt for any such defects. Any errors or defects in the delivery must be reported toMounir Weine AG immediately. If there is a defect or damage for whichMounir Weine AG is responsible,Mounir Weine AG is entitled to choose, at its discretion, between replacing the item or rectifying the defect. The goods must be returned in their original packaging, unused, and complete.


Incorrect Delivery
In the event of an incorrect delivery,Mounir Weine AG agrees to deliver the correct item(s) to the customer, if possible, or, if not, to settle the order with an appropriate replacement (at the customer’s discretion) of equal value. The order cannot be canceled as long as the ordered item is in stock. 


Defective Items
We always inspect defective or damaged items for the relevant defects to ensure that warranty claims are honored. Damage resulting from defective materials or manufacturing defects is handled byMounir Weine AG in accordance with the provisions governing incorrect deliveries. As a general rule, termination of the contractual relationship will not be granted in the event of the above-mentioned occurrences.

Return of Barrel Wines

Wines with a cork taint will be refunded, provided the defect is detectable and the bottle is at least 75 percent full. If the same vintage is still available, the wine with a cork taint will be replaced; otherwise, a refund will be issued in the form of a gift certificate. This policy is valid for three years from the date of purchase.Wines that have exceeded their recommended drinking window are excluded from this policy.


Shipping Damage
In the event of shipping damage, a report detailing the damage must be submitted via email to info@rhodan.ch within 48 hours of receiving the goods; otherwise, the right to a free replacement will be forfeited.

In the event of an incorrect return, any costs incurred byMounir Weine AG in connection with the return will be charged to the customer.


The customer is granted a period of 5 business days from receipt of the merchandise, within which the merchandise may be returned along with a notice of defect.
Please note that a return will never result in a refund as long as the ordered merchandise is available. We reserve the right to reimburse the value of the goods with a gift certificate or an item of equal value.
Shipping costs are generally the responsibility of the customer. Unfortunately, returns that are not sufficiently prepaid cannot be processed. Shipping costs will be refunded to the customer only if the delivery was incorrect, was made byMounir Weine AG, or resulted from manufacturing or shipping damage.


Items Excluded from Exchange
Due to the significant price reduction, items marked down are excluded from exchange.

 

9. Care/Handling

Mounir Weine AG assumes no liability whatsoever for any negligence on the part of the customer in the care and/or handling of the delivered items. We therefore ask customers to follow the relevant instructions.

10. Payment Options and Retention of Title

The customer may choose from the payment options listed during the ordering process.

Mounir Weine AG is the direct point of contact for customers who shop in the online store regarding billing and payment questions.

Mounir Weine AG reserves the right to exclude customers from certain payment options or to require payment in advance without providing a reason. If payment is made in advance, the amount must be transferred within 15 business days.

In the event of late payment by the customer, Mounir Weine AG may charge late payment interest of 5% per year, as well as a reminder fee of up to CHF 20 per reminder. If debt collection proceedings are initiated, the customer will be charged a processing fee of CHF 80.

The products delivered to the customer remain the property ofMounir Weine AG until full payment has been made.

11. General Liability

We hereby expressly state that no claims for liability may be asserted againstMounir Weine AG.

 

12. Retention of Title

The delivered goods remain the property of Mounir Weine AG until full payment has been made.

14. Amendment to the Terms and Conditions

It should be noted here thatMounir Weine AG reserves the right at any time to amend these Terms and Conditions without prior notice in the best interests of the company. In the event of a concluded contract, the version of the Terms and Conditions in effect at the time of the order shall apply.

 

15. Governing Law/Jurisdiction

In any case, the relationship between the customer and the

Mounir Weine AG is governed by Swiss law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB), excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
